Terms of Service

1. Acceptance of Terms

By accessing or using PokerPulse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and PokerPulse.

2. Description of Service

PokerPulse is a web application that helps users organize, run, and manage home poker tournaments and leagues. The Service provides tools including blind timers, player management, chip tracking, payout calculations, and live viewing capabilities.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Provide accurate and complete registration information.
  • Keep your password confidential and not share it with others.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Facilitate illegal gambling where prohibited by law. You are solely responsible for ensuring your use complies with applicable laws in your jurisdiction.
  • Harass, abuse, or harm other users.
  • Transmit spam, malware, or other harmful content.
  • Attempt to reverse engineer, scrape, or disrupt the Service.
  • Impersonate another person or entity.
  • Violate any applicable local, national, or international law or regulation.

5. Legal Disclaimer - Gambling

PokerPulse is a tournament management tool for home games and social play. We do not facilitate real-money gambling transactions. Any exchange of money among players is conducted entirely outside the Service and is solely the responsibility of the users involved. You must comply with all applicable gambling laws in your jurisdiction. We are not responsible for any legal consequences arising from your use of the Service.

6. Subscription and Billing

The Service offers a free tier and a paid Pro subscription. For paid plans:

  • Subscriptions are billed on a recurring basis (monthly or annually).
  • You authorize us to charge your payment method on file at the start of each billing period.
  • You may cancel at any time; access continues until the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support within 7 days of a charge if you believe an error was made.
  • We reserve the right to change pricing with 30 days advance notice.

7. Intellectual Property

All content, features, and functionality of the Service - including but not limited to the design, code, text, graphics, and logos - are owned by PokerPulse and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

You retain ownership of any tournament data, player information, or custom content you create using the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKERHOST PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, illegal activity, or any other reason at our sole discretion. You may delete your account at any time through the Profile settings. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting a notice in the application or via email. Continued use after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
